User Obligations and Responsibilities

Refunds, if applicable, will be processed according to our refund policy as communicated at the time of service booking. We reserve the right to modify our pricing with reasonable notice to existing clients.

We reserve the right to cancel or reschedule services due to unforeseen circumstances, illness, or other factors beyond our control. In such cases, we will make reasonable efforts to reschedule or provide alternative arrangements.

Limitation of Liability

To the fullest extent permitted by applicable law, hypsiggllk, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of our services.

Our total liability to you for all claims arising out of or relating to these Terms or our services shall not exceed the amount you paid to hypsiggllk for the services in question during the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless hypsiggllk, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from or relating to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your conduct in connection with our services.

Termination

We reserve the right to terminate or suspend your access to our services at any time, with or without cause, and with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.

You may terminate your relationship with hypsiggllk at any time by discontinuing use of our services and providing notice as specified in your service agreement.

Upon termination, your right to use our services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

Force Majeure

hypsiggllk shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, labor disputes, government actions, internet service provider failures, or other unforeseeable circumstances.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the competent courts of the Netherlands.

By using our services, you consent to the personal jurisdiction and venue of such courts. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Dispute Resolution

We encourage you to contact us directly to resolve any disputes or concerns. Most disputes can be resolved through good faith communication. If a dispute cannot be resolved through direct communication, we may agree to participate in mediation or other alternative dispute resolution methods.

Any disputes that cannot be resolved through alternative methods shall be resolved through the competent courts of the Netherlands as specified in the Governing Law section above.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable. The failure of either party to exercise any right provided for herein shall not be deemed a waiver of any further rights hereunder.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and hypsiggllk regarding your use of our services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
